Please note only SOME regulations have been repealed.

The Minister of Health has Repealed the regulations with regards to the following products: Ice cream; Meat; Fish, Coffee, Tea, Chicory, Cocoa, Chocolate, Sugar, Icing Sugar, And Edible Gelatine Products.


Explanatory Summary:

  • Food, Drugs and Disinfectants Act, no. 13 of 1929 was repealed when the FOODSTUFFS, COSMETICS AND DISINFECTANTS ACT, 1972 (ACT NO. 54 OF 1972) came into force.
  • Regulations under Act 13 where deemed in force as per Act 54 (FCD Act)
  • Regulations under Act 13 were published as Notice No. 574 & 575 of 28/3/1930 (See attached)
  • Notice 656 of 2019 (attached) repeals some regulations published under Act 13.

o Regulation 11: Ice cream and ice -cream products (already regulated by the DAFF)
o Regulation l4: Meat and fish and their preparations: Edible fats and edible oils -(Except 14(4)(iii))
o Regulation l5: Tea
o Regulation l6: Coffee, coffee mixtures and preparations of coffee
o Regulation l7: Chicory
o Regulation l8: Cocoa and chocolate
o Regulation 27: Sugar, confectionery, dextrose and icing sugar
o Regulation 39 bis: Edible gelatine

  • All regulations repealed will be transferred to other regulatory bodies in accordance with their mandates e.g. agricultural products will be transferred to the Department of Agriculture, Forestry & Fisheries etc.

Impact to business: in the case where business has been utilising the repealed regulations. In the interim, members are advised to comply with the available Codex Standards or the repealed Edible Fats and Oil Regulation.
